General Terms and Conditions of Sale

Article 1 – Service provider identification

Article 2 – Subject matter and scope

These General Terms and Conditions of Sale (T&Cs) govern all services offered by Baila Baila, namely dance classes in Barcelona for groups of 3 to 80 people.

They apply to any booking made via baila-baila.com, through the contact form, or by any other written means.

Any booking implies full and unconditional acceptance of these T&Cs. The client declares having read them prior to completing their booking.

In the event of any discrepancy between the French, English and Spanish versions of these T&Cs, the French version shall prevail.

Article 3 – Description of services

3.1 Types of classes

Baila Baila offers private dance classes in the following categories:

Three packages are available:

  • Découverte: 1 hour
  • Mini Show: 1h30
  • Show Time: 2 hours

3.3 Dance styles

Styles offered include: flamenco, salsa, bachata, girly/lady styling, twerk, pole dancing, bollywood, country, cabaret, disco, reggaeton, hip-hop, belly dancing, samba, heels, striptease/burlesque, tango, zumba. The full list is available at: baila-baila.com/en/dance-styles

3.4 Venues

Classes take place in partner studios located in the heart of Barcelona, primarily in the Born neighbourhood (Carrer dels Carders, 12, 08003 Barcelona – view on Google Maps). Pole dancing classes are held in a studio in the Gràcia neighbourhood. The exact address is confirmed by email after booking.

3.5 Language of instruction

Classes are taught in Spanish and English. Instructors are experienced working with French-speaking groups. No classes are taught in French.

3.6 Legal capacity of participants

By booking, the client certifies that all participants are of legal age (18 or over), or, in the case of school trips, are placed under the legal responsibility of an adult supervisor duly mandated by the school. Baila Baila cannot be held liable for the presence of undeclared minors at the time of booking.

Article 4 – Pricing

All prices are quoted in euros (€) inclusive of applicable taxes. They vary according to:

  • the package chosen (1h, 1h30 or 2h),
  • the number of participants.

For groups of 3 to 20 people, prices are displayed automatically during the online booking process: baila-baila.com/en/book-dance-class-barcelona. For groups of more than 20 people, a personalised quote is provided upon request.

Prices in force are those displayed on the website at the time of booking. Baila Baila reserves the right to modify its prices at any time; the applicable price is that confirmed at the time of booking.

Professional photography and video services are separate add-on services, billed independently.

Article 5 – Booking process

5.1 Groups of 3 to 20 people

Bookings are made online via the form available at baila-baila.com/en/book-dance-class-barcelona. The client selects the dance style, number of participants, package, preferred date and time. Booking is confirmed instantly upon full payment.

5.2 Groups of more than 20 people

For groups of 21 to 80 people, booking is made on a quote basis. The client contacts Baila Baila via the contact form. A personalised quote is sent within 24 hours. The booking is confirmed upon receipt of full payment of the quoted amount.

5.3 Booking confirmation

A confirmation email is sent to the client once the booking is validated. It contains the date, time, exact studio address and a summary of the service. If not received, the client is advised to check their spam folder and contact Baila Baila. The booking is deemed confirmed upon sending of this email by Baila Baila, regardless of its actual receipt by the client.

Article 6 – Payment

Full payment is due at the time of booking.

  • For online bookings (groups ≤ 20 people): payment by credit or debit card via the secure Stripe platform.
  • For quote-based bookings (groups > 20 people): full payment upon confirmation of the quote, according to the terms indicated therein.

No payment is accepted on-site on the day of the class.

In the event of adding participants (see Article 8.3), the balance due is paid online according to instructions provided by Baila Baila. No additional participant will be accepted without prior payment.

Article 7 – Right of withdrawal

Pursuant to Article 16(m) of EU Directive 2011/83/EU on consumer rights, the 14-day right of withdrawal does not apply to contracts for leisure services providing for a specific date or period of performance. Dance class bookings at a fixed date are therefore firm and final upon confirmation, subject to the cancellation conditions set out in Article 8.

Article 8 – Cancellation and modification by the client

8.1 Cancellation

  • More than 15 days before the class date: full refund (100%).
  • Less than 15 days before the class date: no refund. The full amount remains due, as the studio and instructor are already reserved and cannot accept other bookings.
  • In the event of a significant unannounced late arrival on the day: Baila Baila reserves the right to cancel the session without refund.
  • In the event of a no-show without prior contact: no refund, the full amount remains due.

To request a cancellation, the client sends an email by replying to the booking confirmation message. The date of receipt of this email by Baila Baila is the reference date for calculating the applicable deadline. Refunds are processed within 1 to 5 business days to the card used for payment.

8.2 Date or time modification

Any change of date or time is accepted free of charge if requested more than 15 days before the scheduled date, subject to studio and instructor availability. Changes requested with less than 15 days’ notice are not guaranteed and do not entitle the client to a refund if the change cannot be accommodated. Baila Baila is under no obligation to accept a modification request.

8.3 Modification of participant numbers

Adding participants: possible up to 7 days before the date, up to a maximum of 20 people for online bookings. The per-person rate for added participants is the same as for the rest of the group. No additional participants can be accepted on the day of the class, without exception.

Removing participants: a partial refund is possible up to 15 days before the date. After this deadline, the total amount remains due, regardless of the reason for withdrawals.

Article 9 – Cancellation or modification by Baila Baila

In the exceptional event that Baila Baila is unable to provide the service (instructor illness, force majeure, unforeseen technical issue), the client is informed as quickly as possible by email, phone or WhatsApp. Baila Baila will then offer:

  • rescheduling to another time slot during the client’s stay in Barcelona,
  • a replacement instructor or alternative dance style,
  • or, if no solution is acceptable to the client, a full refund.

These options constitute the client’s sole remedy in the event of cancellation by Baila Baila. No additional compensation (travel costs, accommodation, ancillary activities or any other expense) may be claimed.

As classes are held indoors, no cancellation on weather grounds can be invoked.

Article 10 – Force majeure

Neither party shall be held liable for failure to fulfil its contractual obligations in the event of force majeure. Events of force majeure include in particular: natural disaster, earthquake, flood, fire, general transport strike, pandemic, governmental ban on the activity, serious public disorder, or any other event that is unforeseeable, unavoidable and beyond the control of the parties.

In the event of force majeure, Baila Baila will contact the client as soon as possible. If the service cannot be rescheduled, a credit note or full refund will be offered. No compensation beyond the amount paid may be claimed.

Article 11 – Client obligations and liability

The client agrees to:

  • arrive on time (arriving 5 minutes before the start of the class is recommended),
  • ensure that all participants are in a physical condition suitable for the activity,
  • inform Baila Baila before booking of any medical condition, injury or physical limitation that may present a risk during the class,
  • bring a water bottle per participant (no water point available on-site),
  • respect the premises, equipment and instructor’s instructions,
  • ensure that participants are sober and in a fit state to safely practise the activity.

Baila Baila and its partners expressly disclaim all liability for:

  • any accident caused by a participant or resulting from failure to follow the instructor’s instructions,
  • any injury linked to an undisclosed pre-existing medical condition,
  • any damage caused by a participant to the premises, equipment or third parties,
  • loss or theft of personal belongings in the studios.

Each participant takes part in the activity at their own risk and must be covered by their own personal insurance (home insurance with personal accident cover, credit card travel insurance, or a travel insurance policy). Checking this coverage prior to booking is strongly advised.

For pole dancing, participants are strongly advised not to apply cream or oil to their body before the class, as this significantly increases the risk of falling.

The client is liable for any material damage caused to the premises or equipment by members of their group. Repair or replacement costs will be invoiced to the client.

Article 12 – Baila Baila’s liability

Baila Baila holds professional liability insurance.

Classes are led by qualified and experienced instructors. A warm-up is systematically carried out at the beginning of each session. Styles and choreographies are adapted to the level and size of the group.

Baila Baila’s liability is strictly limited to the amount paid by the client for the service in question. Under no circumstances shall Baila Baila be liable for indirect damages, loss of earnings, travel or accommodation costs, intangible losses, or any other expense incurred by the client in connection with their stay in Barcelona.

Baila Baila cannot be held responsible for content published by third parties on review platforms (Google, TripAdvisor, etc.). Clients who have attended a class are welcome to share their experience by posting a review on Baila Baila’s Google listing. Reviews reflect the personal experience of their authors and do not engage Baila Baila’s liability.

Article 13 – Photos and videos

Participants are free to film and take photos during the class using their personal devices.

During the session, the instructor may take photos or videos of the group. This content may be sent to participants and used by Baila Baila for communication purposes (website, social media), unless the client expressly objects in writing at the time of booking. In the absence of any objection, the client accepts this use on behalf of all participants in the group they are organising.

Professional photography and souvenir video clip services are separate add-ons, available on request and billed independently.

Article 14 – Personal data protection

Personal data collected at the time of booking (first name, surname, email, phone number) is used solely for the purpose of managing the service. It is not shared with third parties, except for technical service providers essential to the execution of the service (Stripe payment platform).

In accordance with the General Data Protection Regulation (GDPR – EU 2016/679), the client has the right to access, correct, delete and obtain portability of their personal data. These rights may be exercised by emailing info@baila-baila.com.

Article 15 – Intellectual property

All content on baila-baila.com (texts, photos, videos, choreographies, logo) is the exclusive property of Anne-Lorraine Meunier / Baila Baila and is protected by intellectual property law. Any reproduction, representation or distribution without prior written authorisation is prohibited.

Article 16 – Client reviews

Baila Baila places great importance on client satisfaction. Participants who have completed a booking are welcome to share their experience by posting a review on Baila Baila’s Google listing. Reviews are independent and reflect the personal experience of their authors. Baila Baila cannot be held responsible for the content of reviews written by third parties.

Article 17 – Governing law, language of contract and disputes

These T&Cs are governed by Spanish law, in particular the Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios (TRLGDCU).

The French version of these T&Cs shall prevail in the event of any discrepancy with the English or Spanish versions.

In the event of a dispute, the client is invited to contact Baila Baila first by email at info@baila-baila.com to seek an amicable resolution. Failing an amicable resolution within 30 days, the dispute will be brought before the competent courts of Barcelona (Spain), to which the parties exclusively attribute jurisdiction.

Article 18 – Miscellaneous

If any clause of these T&Cs is found to be null or unenforceable by a court of competent jurisdiction, the remaining clauses remain fully in force.

The fact that Baila Baila does not invoke a provision of these T&Cs at any given time shall not be construed as a waiver of the right to invoke it at a later date.

Baila Baila reserves the right to amend these T&Cs at any time. The applicable version is that in force at the date of booking, as published on baila-baila.com.
